Dear Customers and Travelers,
The following provisions, insofar as effectively agreed upon, shall become
part of the package travel contract concluded between the customer and
JUST TRAVEL GMBH - hereinafter referred to as “JUST TRAVEL” - upon
contract conclusion. They supplement and complete the statutory provisions
of Sections 651a - y of the German Civil Code (BGB) and Articles 250 and
252 of the Introductory Act to the German Civil Code (EGBGB). Please
therefore read these travel conditions carefully before making your booking.
1.1. Insofar as individual services are not expressly designated in the travel description as part of the package tour offered and operated by JUST TRAVEL, JUST TRAVEL does not offer these individual services as its own services, but rather as arranged services in addition to the package tour.
1.2. As an intermediary, JUST TRAVEL acts as an intermediary for linked travel services insofar as the legal requirements pursuant to Section 651w BGB for arranging linked travel services by JUST TRAVEL are met.
1.3. Without prejudice to the obligations of JUST TRAVEL as a provider of linked travel services (in particular the delivery of the legally required form and the implementation of customer money protection in the event of collection activities by JUST TRAVEL) and the legal consequences in the event of non-fulfillment of these statutory obligations, JUST TRAVEL is neither the tour operator nor the contractual partner of the contract concluded for the arranged individual service in cases where the requirements under 1.2 or 1.3 are met. Accordingly, JUST TRAVEL shall not be liable for information provided by the arranged contractual partner regarding prices and services, for the performance of the services themselves, or for damages arising from these arranged services. Any liability of JUST TRAVEL arising from the intermediary contract and statutory provisions, in particular mandatory provisions concerning telemedia and electronic commercial transactions, shall remain unaffected.
1.4. The role as intermediary obligates JUST TRAVEL in particular to:
a) Indicate in the respective offer for arranging a service that
JUST TRAVEL acts as an intermediary, specifying the provider and
contractual partner in the event of booking
b) State the price of the arranged service separately from the price
of the package tour
c) Provide the customer with a booking confirmation corresponding to
the above information, in which the price of the arranged service is
shown separately.
1.5. The foregoing provisions do not affect the liability of JUST TRAVEL arising from the intermediary contract.
2. Conclusion of the Package Travel Contract, Obligations of the Customer
a) The basis of the offer by JUST TRAVEL and the customer’s booking
is the travel description and supplementary information provided by
JUST TRAVEL for the respective trip, insofar as these are available
to the customer at the time of booking.
b) Travel agents and booking offices are not authorized by
JUST TRAVEL to make agreements, provide information, or give
assurances that alter the agreed content of the package travel
contract, exceed the travel description or the services contractually
promised by JUST TRAVEL, or contradict them.
c) Information in hotel guides and similar directories not published
by JUST TRAVEL is not binding for JUST TRAVEL and its obligation to
provide services unless such information has been expressly agreed with
the customer as part of JUST TRAVEL’s contractual obligations.
d) If the content of the travel confirmation from JUST TRAVEL differs
from the content of the booking, this shall constitute a new offer by
JUST TRAVEL, to which JUST TRAVEL shall be bound for a period of two
days. The contract shall be concluded on the basis of this new offer
insofar as JUST TRAVEL has informed the customer of the change,
fulfilled its pre-contractual information obligations, and the customer
declares acceptance to JUST TRAVEL within the binding period either by
explicit declaration or payment of a deposit.
e) The pre-contractual information provided by JUST TRAVEL regarding
essential characteristics of the travel services, the travel price and
all additional costs, payment arrangements, minimum number of
participants, and cancellation fees (pursuant to Article 250 Section
3 Nos. 1, 3 to 5 and 7 EGBGB) shall only not become part of the
package travel contract if expressly agreed between the parties.
f) The customer shall be liable for all contractual obligations of
fellow travelers for whom the booking is made as for their own,
provided the customer has assumed such obligation through an explicit
and separate declaration. The same applies accordingly to group clients
or group leaders with regard to closed group tours within the meaning
of Section 18 below and the travelers registered by the group client
or group leader.
a) By making the booking, the customer offers JUST TRAVEL the binding
conclusion of the package travel contract. The customer shall be bound
by the booking for 10 working days.
b) The contract is concluded upon receipt of the travel confirmation
(acceptance declaration) by JUST TRAVEL. Upon or immediately after
contract conclusion, JUST TRAVEL shall provide the customer with a
travel confirmation complying with legal requirements on a durable
medium (allowing the customer to store or save the declaration
unchanged in such a way that it remains accessible for an appropriate
period of time, e.g., on paper or by email), unless the traveler is
entitled to a paper confirmation pursuant to Article 250 Section 6
Paragraph (1) Sentence 2 EGBGB because the contract was concluded in
the simultaneous physical presence of both parties or outside business
premises.
